IMPORTANT – PLEASE READ CAREFULLY: These Terms and Conditions (“Terms”) form a legal agreement between you (“you” or “the customer”) and Spares 2000 CC, trading as Sharp-Rite (“Sharp-Rite”, “we”, “us” or “our”), for your use of this website (the “Website”) and any purchase of merchandise or services advertised on it. By accessing or using this Website, or by placing an Order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this Website.
These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”). Where any provision of these Terms conflicts with a right you have under the CPA or ECTA, your statutory right takes precedence.

2. Orders and forming a contract
When you place an Order on this Website, you are making an offer to purchase the merchandise or services in your Order, subject to these Terms. A contract is only formed once we send you confirmation that your Order has been accepted, whether by email or another written communication. Until that confirmation is sent, we may accept or decline any Order at our discretion, including where merchandise is listed at an incorrect price, is out of stock, or the Order details appear to be fraudulent or in error.
You must be at least 18 years old, or have the consent of a parent or guardian, to place an Order on this Website.
3. Pricing and payment
All prices on this Website are quoted in South African Rand and are inclusive of VAT where applicable, unless stated otherwise. Prices are subject to change without notice, but changes will not affect an Order we have already confirmed.
Card and other electronic payments are processed securely by our payment gateway, Peach Payments. We do not collect or store your full card number, expiry date or CVV ourselves; these are captured directly by Peach Payments’ secure payment page. We also accept EFT/bank transfer where offered at checkout.
If your Order is refused or cancelled after payment has been taken, we will refund the full amount to the original payment method within a reasonable time.
4. Delivery
We deliver nationwide across South Africa. Estimated delivery times and shipping costs, including our free delivery threshold, are set out on our Delivery & Returns page. Delivery timeframes are estimates and not guaranteed; we will let you know as soon as possible if we expect a significant delay.
5. Returns, refunds and exchanges
Our full returns process, including how to request a return and how refunds are processed, is set out on our Delivery & Returns page, which forms part of these Terms. In summary, and subject to that policy, eligible items may be returned within 7 days of delivery for a full refund.
Unless otherwise stated on the product page, the following items cannot be returned or refunded once delivered, except where the item is defective or was supplied in error:
- Products that have been used, installed, or show signs of wear
- Products with a broken seal, security tape or protective packaging that has been removed
- Consumable items, such as blades, discs, drill bits, sanding accessories and similar wear parts
- Clearance, sale or “as-is” items sold at a reduced price
- Digital goods, such as licence keys or downloadable software, once activated or delivered
This does not affect your rights under the Consumer Protection Act in respect of defective, unsafe or faulty goods, which are dealt with under section 6 below.
6. Your rights under the Consumer Protection Act
As a South African consumer, you have rights under the CPA that these Terms do not limit or exclude, including the right to:
- Receive goods that are of good quality, in good working order and free of defects
- Receive goods that are reasonably suited to the purpose for which they are commonly used
- Return goods that fail, are defective, or are unsafe within six months of delivery, for repair, replacement or refund at your choice, at no charge, unless you were expressly informed of the defect before purchase
- Fair, honest dealing and clear, understandable information about the goods and services we offer
If you believe goods you purchased from us are defective, please contact us using the details in section 11 so we can resolve this promptly.
7. Using this Website
You agree to use this Website only for lawful purposes and not to:
- Attempt to gain unauthorised access to any part of this Website or our systems
- Interfere with or disrupt the operation of this Website
- Post or transmit any unlawful, defamatory, abusive or fraudulent content
- Use this Website to infringe the intellectual property or other rights of any person
- Provide false information when registering an account or placing an Order
If you register an account, you are responsible for keeping your login details confidential and for all activity under your account. Please notify us immediately if you suspect any unauthorised use of your account.
8. Intellectual property
Unless otherwise indicated, all trademarks, logos, product images and content on this Website belong to Sharp-Rite or to the brand owners whose products we sell. You may view and print pages of this Website for your own personal, non-commercial use, but may not otherwise copy, reproduce, republish or distribute any content from this Website without our prior written consent.
9. Liability
To the extent permitted by law, and without limiting any right you have under the CPA, Sharp-Rite will not be liable for any indirect or consequential loss arising from your use of this Website. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded or limited under South African law.
This Website and its content are provided on an “as is” and “as available” basis. While we take reasonable care to keep information on this Website accurate and up to date, product descriptions, images, availability and pricing may occasionally contain errors, which we will correct as soon as we become aware of them.
10. Privacy
Our collection and use of your personal information is described in our Privacy Policy, which complies with the Protection of Personal Information Act 4 of 2013 (POPIA) and forms part of these Terms.
11. Complaints and dispute resolution
If you have a complaint about an Order, our products or this Website, please contact us first at [email protected] or 011 624 3185 so we can try to resolve it directly. If we are unable to resolve your complaint, you may refer it to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission, or pursue any other remedy available to you under South African law. Any legal proceedings relating to these Terms will be subject to the jurisdiction of the South African courts.
12. Changes to these Terms
We may update these Terms from time to time to reflect changes in our business practices or the law. The updated Terms will apply from the date they are posted on this Website, and will not affect Orders placed before that date.
